1. Agreement to Terms
By accessing or using Kyvera's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
2. Description of Services
Kyvera provides AI-powered support and analytics tools for Microsoft Dynamics 365 Business Central users, including:
- Kyvera Assist: AI-powered Q&A and troubleshooting for Business Central
- Kyvera Insights: AI-powered analytics and reporting connected to your BC environment
- Human Expert Escalation: Access to BC consultants (Enterprise tier)
3. Account Registration
To use our services, you must create an account and provide accurate information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscription and Payment
Trial Access
We offer guided trial access as part of our onboarding process. Trial access is provided upon completion of a demo and at our team's discretion. Contact us to learn more.
Subscription Plans
- Plans are billed monthly or annually as selected at checkout
- Annual plans are paid in advance and are non-refundable except as required by law
- Prices are subject to change with 30 days notice
Cancellation
- Monthly plans: Cancel anytime, effective at end of billing period
- Annual plans: Cancel with 30 days notice before renewal
- No refunds for partial periods except as required by law
5. Acceptable Use
You agree not to:
- Use our services for any illegal purpose
- Attempt to reverse engineer or extract our AI models
- Share account access with unauthorized users
- Upload malicious code or attempt to breach our security
- Use automated tools to scrape or overload our systems
- Resell or redistribute our services without authorization
6. Intellectual Property
Our IP: Kyvera owns all rights to our platform, AI models, documentation, and branding. You may not copy, modify, or distribute our materials without permission.
Your Data: You retain ownership of all data you provide to us. You grant us a license to use this data solely to provide our services.
7. AI-Generated Content
Our AI provides information based on Microsoft documentation and general BC best practices. However:
- AI responses are provided "as is" and may contain errors
- You should verify important information before acting on it
- AI responses do not constitute professional consulting advice
- We are not responsible for decisions made based on AI responses
8. Business Central Integration
If you connect your Business Central environment (Pro tier and above):
- You authorize us to access your BC data as needed to provide services
- You represent that you have authority to grant this access
- We access data in read-only mode unless explicitly authorized otherwise
- You can revoke access at any time through your BC admin portal
9. Service Level Agreement
Enterprise tier customers receive our SLA with 99.9% uptime guarantee. Standard and Professional tiers are provided on a reasonable-efforts basis. See our Security page for details.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our liability is limited to the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for decisions made based on AI-generated information
- We are not liable for issues caused by your Business Central configuration
11. Indemnification
You agree to indemnify and hold Kyvera harmless from claims arising from your use of our services, violation of these terms, or infringement of third-party rights.
12. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use our services ends immediately. We will provide data export options where legally required.
13. Modifications
We may modify these terms at any time. Material changes will be notified via email or through our platform 30 days in advance. Continued use after changes constitutes acceptance.
14. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes will be resolved in the courts of Delaware.
